Abstrak

Background to ensure public safety in metropolitan cities has become a daunting task more so when people walk into public spaces, hid their face and it become impossible to identify someone personally. These types of events do not allow for any prevention of crimes and terrorism, thus a concern is raised among the people. This is significant because Uzbek legislation had previously not contained any explicit provisions relating to face-covering in public. Despite increasing international attention on this issue Deemed the legal gap, this left law enforcement officials challenged in preventing public spaces such as the metro from being safe and secure. This is a comparative legal analysis that uses legislation in France, Belgium, Austria, Denmark, Bulgaria and the Kyrgyz Republic to demonstrate how covering the face in public is prohibited by law. The research identifies the best practices and determines their relevance to the legal system of Uzbekistan. Results: The analysis shows that most countries apply an administrative fine or penalty for facial concealment in the public sphere. These laws are great deterrents curb criminal acts while paving way for social trust and openness. Following the global trend, Uzbeskistan has passed Law No. ZRU-874 (31 October 2023), which launched Article 184⁴ of the Code of Administrative Responsibility, which warned against of being in public places in a manner that makes identify impossible, except for medical, professional, or artistic causes. Fines are between 10 and 15 times the basic calculation rate for violations. Impacts: The new public safety law will augment the maintenance of public order, bolster crime deterrence and ensure the constitutional rights of citizens. It brings the legal framework of Uzbekistan in line with international requirements for provision of transparency and security in public life.
